Terms of Service
These terms are an agreement between you and BullardConsulting, LLC ("we", "us"), which operates ManagerIQ Foodservice at https://app.generalmanagertraining.net (the "Service"). By creating an account or using the Service you agree to them.
Effective [[EFFECTIVE DATE: the day these pages go live]]
1. What the Service is
ManagerIQ Foodservice is a management-training service for foodservice operators. It offers operating cases, conversation and email practice, a free lesson, and an optional tool (“IQ Analytics”) that lets you import your own sales, labor and inventory summaries and look at them alongside your training. Feedback and scores are produced partly by artificial intelligence.
2. Training and feedback, not advice
- Scenarios are fictional. The restaurants, people and numbers in cases and role-plays are made up for practice.
- AI feedback can be wrong. Scores and comments are a learning aid. They may be inaccurate, inconsistent between attempts, or miss context. They are not an evaluation of you, your employees or your business.
- Not professional advice. Nothing in the Service is legal, employment, human-resources, tax, accounting, food-safety, health-code or regulatory advice. Follow the laws and rules that apply to your business and ask a qualified professional when it matters.
- No employment decisions. Do not use scores or feedback to hire, discipline, promote or terminate anyone.
- No credential. A score or a certificate of completion is not a professional license or certification. Unless a certificate displays a certifying board’s approval number, it is not approved for continuing-education credit.
- IQ Analytics shows arithmetic on the numbers you import. It does not connect to your point-of-sale, payroll or inventory systems, does not verify your data, and does not establish why a number changed.
3. Your account
You must be at least 18 and able to form a binding contract. Give us a real email address you control and keep your password private. You are responsible for activity under your account. Accounts are for one person: do not share your login or resell access. Tell us promptly if you think someone else has used your account.
4. Membership, price and billing
- Plans. Monthly $29 and annual $289 (US dollars), or the price shown at checkout when you buy. Some content, such as the P&L Fundamentals lesson, is free.
- Payments are handled by Stripe. You pay on Stripe’s secure checkout page and Stripe processes your payment. We do not see or store your card number. Stripe’s own terms and privacy policy apply to that payment.
- Automatic renewal. A membership renews automatically for the same period until you cancel, and you are charged the then-current price. We will give notice of a price change before it applies to you.
- Cancelling. You can cancel at any time from the Billing page (it opens Stripe’s customer portal, where you can also update your card and see invoices). After you cancel, your access continues to the end of the period you already paid for, and you will not be charged again. See the Refund Policy for refunds.
- Taxes. Prices may not include sales or use tax. Where tax is required it is calculated and added at checkout before you pay.
- Payment problems. If a payment fails or is reversed, access may end.
5. AI usage allowance
Each membership includes 100 AI-scored or AI-coached interactions per calendar-month slice of your paid period; on the annual plan the allowance resets each month, not once a year. Lessons, dashboards, your saved results and your own data imports do not use the allowance. Different activities use different amounts (for example, a live role-play uses more than a written response), and the amount is shown before you start. Unused interactions do not carry over. We may adjust the allowance for new features with notice, and we may limit use that looks automated or abusive.
6. Acceptable use
Do not:
- upload customer, employee, payroll-detail, payment-card or other personal information to IQ Analytics or type it into training responses. Import only business summaries you are authorized to use (daily totals, item counts), and use the column mapping to leave other columns out;
- copy, scrape, or use automated tools to access the Service, or extract the scenarios, answer keys or scoring rules;
- try to get around usage limits, billing, or security, or attempt to access another person’s data;
- use the Service to break the law or to create harmful, harassing or deceptive content;
- try to manipulate the AI to behave outside the training purpose.
We may suspend or end accounts that break these rules.
7. Your content
You keep ownership of what you write and import (“Your Content”). You give us a limited, non-exclusive license to store, process and display Your Content, and to send it to our service providers (including AI providers), only as needed to run the Service for you. We may also use de-identified, aggregated information about how the Service is used to improve it. How we handle personal information is described in the Privacy Policy.
8. Our content and intellectual property
The Service, including its scenarios, rubrics, scoring, text, design and software, belongs to BullardConsulting, LLC or its licensors and is protected by law. We give you a personal, non-transferable, revocable right to use it for your own training while your account is in good standing. You may not copy, distribute or make derivative works from it except as the Service allows.
9. Third-party services
The Service depends on other companies, including payments (Stripe), hosting and database (Netlify and Supabase) and AI (Anthropic and OpenAI). They may be unavailable or change, and their own terms apply to their services. We are not responsible for them.
10. Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free. We may change, add or remove features and content. If we make a change that materially reduces what a paid member receives, we will tell you and you may cancel.
11. Ending your account
You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end your access if you breach these terms or if required by law. Sections that by their nature should continue (such as ownership, disclaimers, limits of liability and governing law) survive.
12. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that using the Service will improve your results, your performance reviews, your employment, or your business’s financial, inspection or safety outcomes.
13. Limit of liability
To the fullest extent the law allows, BullardConsulting, LLC and its owners, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose. Some places do not allow certain limits, so parts of this section may not apply to you.
14. Your responsibility for claims
If a third party brings a claim because you uploaded data you were not allowed to upload, or because you misused the Service, you agree to cover our reasonable losses from that claim to the extent the law allows.
15. Governing law and disputes
These terms are governed by the laws of [[GOVERNING STATE: the state whose law and courts apply]], without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located there, except where the law gives you the right to bring them elsewhere. Before filing a claim, please email us so we can try to resolve it informally.
16. Changes to these terms
We may update these terms. If a change is material we will notify you by email or in the Service before it takes effect. If you keep using the Service after the effective date, you accept the updated terms.
